These Terms and Conditions ("Terms") govern your use of LobsterTank ("the Service"), a managed hosting platform for OpenClaw, an open-source personal AI assistant. By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

LobsterTank provides managed hosting for OpenClaw AI assistant instances. The Service includes:

  • Provisioning and managing dedicated virtual private servers
  • SMS-based interaction with your AI assistant
  • Phone number registration for SMS communication
  • Account management and configuration tools

2. Account Requirements

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide a valid AI provider API key (e.g., Anthropic, OpenAI, Google) to use the AI assistant features. You are responsible for compliance with your AI provider's terms of service.
  • One account per person. You may not create multiple accounts.

3. SMS Communication

By registering your phone number with LobsterTank, you agree that:

  • You consent to receive SMS messages from the Service, including verification codes and AI assistant responses.
  • Standard message and data rates from your mobile carrier may apply.
  • Message frequency depends on your usage of the Service.
  • You may opt out of SMS messages at any time by texting STOP to our service number or by removing your phone number in account settings.
  • You will only register phone numbers that you own or are authorized to use.
  • You will not use the SMS service to send spam, harassing, or illegal content.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, unsolicited messages, or bulk communications
  • Harass, threaten, or harm others through your AI assistant
  • Generate illegal, harmful, or abusive content through the AI assistant
  • Attempt to gain unauthorized access to other users' instances or data
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service (except for the open-source OpenClaw components)
  • Use the Service in a way that could damage, disable, or impair the Service
  • Resell, sublicense, or commercially redistribute the Service without authorization

5. AI Assistant Limitations

  • AI assistant responses are generated by third-party AI models and may contain errors, inaccuracies, or inappropriate content.
  • LobsterTank does not control or guarantee the accuracy, reliability, or appropriateness of AI-generated responses.
  • You should not rely on AI assistant responses for medical, legal, financial, or other professional advice.
  • You are responsible for how you use information provided by the AI assistant.

6. API Keys and Security

  • Your AI provider API keys are encrypted at rest and transmitted securely.
  • You are responsible for any charges incurred on your AI provider account through usage of the Service.
  • You should not share your LobsterTank account credentials or AI provider API keys with others.
  • Notify us immediately if you suspect unauthorized access to your account.

7. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service.
  • We may perform maintenance that temporarily affects service availability.
  • We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

8. Payment and Billing

  • Subscription fees, if applicable, are billed in advance on a recurring basis.
  • You authorize us to charge your payment method for all fees associated with your subscription.
  • Infrastructure costs (server hosting, SMS messages) are included in your subscription or billed as described in our pricing.
  • AI provider API usage is billed directly by your AI provider, not by LobsterTank.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.

10. Intellectual Property

  • The Service (excluding open-source components) is owned by LobsterTank and protected by applicable intellectual property laws.
  • OpenClaw is open-source software and is governed by its own license.
  • You retain ownership of your data, including messages and configuration.

11. Termination

  • You may close your account at any time through account settings or by contacting us.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your server instances will be destroyed and your data will be deleted in accordance with our Privacy Policy.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOBSTERTANK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Indemnification

You agree to indemnify and hold LobsterTank harmless from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
